What is the Malawi Labours Relations Act About?
Malawi Labours Relations act is the section of the republic of Malawi that guarantees the right of private sector employees to organize into trade unions, engage in collective bargaining, and take collective action such as strikes. It also prohibits discrimination on grounds of race, colour, nationality, ethnic or social extraction, religion, political opinion, language, sex, marital status, family responsibilities, age, disability, property or birth.
Apart from ensuring the right of private sector employees to form unions, participate in collective bargaining, and take collective action like strikes, the Malawi Labour Relations Act also lays down rules for the registration and formation of trade unions. The Act also mandates procedures for employers to recognize trade unions and the negotiation and acceptance of collective agreements.
Additionally, the Act outlaws any form of discriminatory practices by employers based on factors such as race, color, nationality, ethnicity, religion, political opinions, language, sex, marital status, family obligations, age, disability, property, or birth. These discriminatory practices include unfair treatment during recruitment, promotion, training opportunities, and dismissal or termination of employment.
The Act further establishes the Employment Relations Tribunal, which is responsible for hearing and resolving disputes related to unfair labor practices, discrimination, and conflicts between employers and employees or trade unions. The Act also establishes the Industrial Relations Court, which has the power to settle disputes arising from collective agreements.
